GALVESTON – A La Marque man is suing AccentCare, Inc., doing business as Texas Home Health, and Melancon Enterprises, LLC, doing business as Priority Healthcare, over what he asserts was “substandard healthcare.”
James Marshall’s lawsuit, which was filed in the Galveston County 405th District Court on Aug. 6, states that it was the defendants’ responsibility to help him with moving and turning to avoid the development of pressure ulcers.
A quadriplegic as a result of a motorcycle accident many years ago, Marshall alleges he nevertheless suffered “painful Stage 3 and Stage 4 pressure ulcers, which ultimately required months of hospitalization.”
“The conduct of the defendants was well below the standard of care and proximately caused—to a reasonable degree of medical probability—the injuries in question,” court papers say.
Consequently, Marshall seeks unspecified monetary damages and a jury trial.
